1. Who we are

2. The service
Valinka finds places in public travel posts and in photos or videos you upload, using automated analysis (AI), and lets you plan trips with them.
Places are found by automated analysis and can be wrong or incomplete. Check opening hours, addresses and prices before you go.
We do not guarantee that the service is always available, and features may change.
3. Your account
You sign in with Google or Apple only. One person per account; keep your access safe and do not share it.
You must be at least 18 years old to use Valinka.
You can delete your account at any time: see Delete account.
4. Credits and purchases
A new account receives 5 free credits, once per Google or Apple identity. Deleting an account and creating it again does not give them a second time.
One credit is used for each video or photo analysed. Adding places by search or from a Google Maps link is free.
A failed import is never charged: if an import fails or finds no place, its credit is returned automatically.
To prevent abuse, imports may pause for a while after several failed imports in a day. You are not charged for them.
Credit packs are sold as in-app purchases through the App Store or Google Play, at the price shown there. Payment is handled by Apple or Google; we never receive your card details.
Credits never expire while your account exists. They have no cash value, cannot be transferred to another account and cannot be exchanged for money.
5. Refunds
Purchases go through Apple or Google and their refund process: Apple (reportaproblem.apple.com) or Google Play (your order history). If a store refunds a purchase, the credits from that purchase may be removed. This does not limit your statutory consumer rights.
Right of withdrawal. If you live in the EU, EEA or UK, you have a right to withdraw from a purchase of digital content. It ends when the credits are delivered only if you expressly agreed to immediate delivery and acknowledged at checkout that you lose the right.
Legal guarantee. If credits or the service do not work as described, you keep your statutory remedies.

6. Invite a friend
Invite a friend: when a new user redeems your invite link or code within 7 days of their first sign-in, you both receive 3 credits. Each new account can redeem one invite. An invite code pays at most 10 times in any 30 days; after that neither side receives credits. You cannot invite yourself.
We can change or end this programme for the future. We can cancel referral credits obtained by abuse, such as self-referral or fake accounts.
7. Acceptable use
You must not: import or upload content you have no right to use; upload illegal, hateful, sexual or violent content; create accounts to collect free credits; use bots or scripts; try to bypass limits or access other users’ data; resell the service.
8. Your content and shared trips
Links to public content. When you submit a link to a public post from another platform, you confirm that you may share that link. We analyse the public post to find places. We claim no rights in that content; it stays its owner’s. The place facts we extract are not your content.
Files you upload. You keep ownership of the photos and videos you upload. You give us a limited, non-exclusive, worldwide, royalty-free licence only to host, analyse and show them to you and to the people you share with, for as long as needed to run the service. Uploaded files are deleted after analysis, as the Privacy Policy explains. You must have the right to upload what you upload.
Notes and trip content. You keep ownership of your notes and trips. You give us the same limited licence for them: only to host and show them to you and the people you share with, as long as needed to run the service.
A trip you share by link can be viewed, and saved as a copy, by any signed-in person who has the link. “Reset link” stops the old link at once. Copies already saved by others stay theirs.
People you invite to plan a trip (up to 10 per trip, you included; invite links last 7 days) can see the trip and add, skip and order places. They see the name you chose and you see theirs. The owner can remove a member; a member can leave. What you add to someone else’s trip stays in that trip after you leave or delete your account, as the Privacy Policy says; your name is removed.
Reporting illegal content. To report illegal content in a shared trip, use “Report this trip” in the app, or write to support@valinka.app with:
- why you think it is illegal;
- the trip link or its exact location;
- your name and email (optional for reports of child sexual abuse material);
- a statement that your report is accurate and made in good faith.
We confirm that we received your report and decide diligently. We tell you and the trip owner the decision and the reasons, and how to contest it. We may remove content or links that break these terms. [DSA classification — O25]
9. Third-party services and content
Valinka uses Google Maps and Places data and photos, Unsplash photos and public posts from social platforms. Their own terms apply to that content. Valinka is not affiliated with Instagram, TikTok, YouTube, Facebook or Google.
10. Our rights
The service, the Valinka brand and the mascots belong to us. We let you use the service for personal, non-commercial use under these Terms.
11. Suspension and termination
We may suspend or close an account that breaks these terms or abuses the service (see Acceptable use). We warn you first and explain why, unless the breach is serious or the law prevents it. You can contest a decision by writing to support. You may stop at any time by deleting your account.
Credits you already bought are not taken away or changed retroactively: their price and the fact that they never expire stay as they were. If you delete your account, your unused credits are deleted with it. If we close the service, we refund unused purchased credits where the law requires.
12. Liability
We are liable under applicable law. Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, gross negligence or wilful misconduct, or any liability that cannot be limited by law, and nothing limits your mandatory consumer rights.
Otherwise, we are not liable for losses that were not foreseeable, nor for business losses: the app is for personal use.
Place information such as hours and addresses is found automatically and may be wrong. Check before you go.
13. Governing law and disputes
German law applies. You keep the protection of the mandatory consumer laws of the country where you live. You can bring claims in the courts competent under applicable law, including those of where you live.

We provide these terms in English and French. If they differ, the version more favourable to you as a consumer applies.
14. App Store and Google Play
For the iOS app, Apple’s standard Licensed Application End User License Agreement applies to your use of the app. These Terms cover the Valinka service. For Google Play, the Play terms apply to the store purchase.
15. Changes
We may update these terms. Changes apply only for the future. The date at the top changes, and material changes are announced in the app before they apply.
